This is an excerpt of what my friend ~Weasels-Revenge answered me so kindly in a note after I asked him for some advice on this matter. My question and his answer regards mostly Facebook, but they are applicable elsewhere. I think it's of great importance for you all to read. (Go to ~Weasels-Revenge DA page and journals to know more.) By having your work linked by the sharelink button, FB are claiming they can use the actual work hosted here on DA for anything they want. FBs definitions of "use" and "Facebook" are so broad that they could, for example, use a piece of your artwork (that has been shared on FB via the sharelink button) in an advertisement, and you would be entitled to nothing. DA, by enabling the sharelink buttons on their site are essentially saying to FB, "because you allowed us to use your sharelink buttons, we will adhere to your terms and allow you to use the linked artwork as per your terms" [...] Also watermarking the images pretty much insures FB won't be able to use them, although they could, in fact, create derivative works based on the orginal piece. In essence, plagarise the idea or the visual representation. In short, make an exact copy. I've received an opinion from someone involved in law that, and note this could be quite important: 1. DA don't have to give an opt-out at all. That it's pretty much use DA as is or leave. 2. FB can use your work in, say, advertisements merely because it's linked via the sharelink. This I already knew and is the key point because if FB can't use your work like this, it would completely negate the possible ramifications that I outlined in my previous journal. If they can use your work like this, the arguement and method to protect oneself that I outlined in the same said journal SHOULD still stand. 3. And most importantly (and note that I said above - SHOULD, as in you should be able to protect yourself BUT..) FB claim that by using the sharelink button to link to a FB page, their licence to use that work (as I said, in say, an advertisement) SUPERCEDES any other licence, including that of the original copyright holder. This last point is huge. It probably wouldn't stand in court but imagine the hassle and expense you would have in order to prove, in court, that this claim isn't lawful. I honestly don't think, unless you're prepared to go to an awful lot of trouble post-use (by FB) of your work that there's any real way to protect yourself and I would advise anyone who values their work (it seems an awful lot don't) to remove it from DA. ______ Usage: If you're a subscriber, just copy and paste the : thumb 123456 : code into your comments (minus the spaces). Seriously though, it is a smart move business wise on their end, but they prove once again that they are far from devious, and follow the popular crowd like weak sheep only after money. This is a huge low for them in that respect if you ask me. There should be an option to turn that off.
You can turn off comments,
but also should be able to turn of share, stats, thumb & links and favs as well imho.
